Welcome to Magicgate. These Terms of Service ("Terms") govern your access to and use of the Magicgate traffic filtering and cloaking platform (the "Service"), operated by Magicgate ("we", "us", "our").
By registering for an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree with any part of these Terms, you must not use the Service.
Magicgate is a traffic filtering and cloaking platform that evaluates visitor attributes against user-defined rules and returns a verdict (offer or white). The Service operates in two modes:
The Service includes, but is not limited to: flow management, rule configuration, traffic analytics, visitor logs, domain management, blacklist management, white page generation, API access, and real-time statistics dashboards.
To use the Service, you must:
You are solely responsible for all activities that occur under your account. Magicgate may access your account for support, maintenance, security, or compliance purposes.
New users may access the Free plan at no cost, which includes 5,000 clicks per month, 1 flow, 3 rules per flow, and 4 basic filters. The Free plan is available indefinitely and requires no credit card.
During use of the Free plan, warranty, indemnification, and SLA provisions do not apply. We reserve the right to modify or discontinue the Free plan with 30 days notice.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations in your jurisdiction. The Service is provided as a traffic filtering and routing tool — you are solely responsible for the content of your landing pages, offers, and campaigns.
We reserve the right to investigate and take appropriate action against anyone who violates these terms, including suspending or terminating accounts and reporting to law enforcement authorities when necessary.
The Service, including all software, algorithms, interfaces, documentation, trademarks, logos, and content created by Magicgate, is protected by intellectual property laws and remains the exclusive property of Magicgate.
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your subscription.
You retain all ownership rights to your data, including flow configurations, rules, blacklists, white page content, and any data you submit to the Service.
Magicgate does not claim ownership of your campaign data, traffic data, or configurations. We process this data solely to provide and improve the Service.
You grant Magicgate a limited license to process, store, and transmit your data as necessary to operate the Service. This license terminates when you delete your data or close your account.
Aggregated, anonymized data (that cannot identify individual users) may be used by Magicgate to improve the Service, generate benchmarks, and conduct research.
Starter and above plans allow you to connect custom domains to the Service for Direct Mode traffic filtering.
Pro and above plans include access to the Magicgate Management API.
Magicgate strives to maintain high availability but does not guarantee 100% uptime. The Service is provided on an "as is" and "as available" basis.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, Magicgate does not warrant that:

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT YOU PAID TO MAGICGATE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
Magicgate shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:
In such events, affected obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to mitigate the impact and resume normal service as quickly as possible.
You agree to indemnify, defend, and hold harmless Magicgate and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

This confidentiality obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and close your account.
